Agreement to Terms
By accessing or using the services of Omire Law Advocates ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our services or website.
No Attorney-Client Relationship
Viewing this website, submitting a contact form, or sending us an email does not create an attorney-client relationship. An attorney-client relationship is established only through a signed engagement letter or retainer agreement. Until such time, any information you provide is not protected by attorney-client privilege.
Legal Services
Our legal services are provided in accordance with the Laws of Kenya and are subject to:
- The Advocates Act and Rules made thereunder
- The Law Society of Kenya's Code of Standards and Guidance
- Professional ethics and conduct requirements
- Terms outlined in individual engagement letters
Fees and Payment
- Legal fees will be outlined in your engagement letter and may be based on hourly rates, fixed fees, or contingency arrangements
- Payment terms will be specified in your engagement letter
- We reserve the right to cease work if payments are not made as agreed
- You are responsible for all disbursements, court fees, and third-party costs
- Late payment may incur interest charges as specified in the engagement letter
Client Responsibilities
As a client, you agree to:
- Provide complete, accurate, and timely information
- Respond promptly to requests for information or documentation
- Attend scheduled meetings and court appearances
- Follow legal advice and instructions provided
- Pay fees and costs as agreed
- Inform us immediately of any changes in circumstances affecting your matter
Confidentiality
We are bound by strict professional duties of confidentiality. All information shared with us in the course of legal representation is confidential and protected by attorney-client privilege, subject to limited exceptions required by law or professional conduct rules.
Limitation of Liability
While we strive to provide excellent legal services, we cannot guarantee specific outcomes. Our liability is limited as follows:
- We are not liable for outcomes beyond our reasonable control
- We are not responsible for decisions made by courts, tribunals, or third parties
- Our liability is subject to professional indemnity insurance coverage
- Claims must be brought within the time limits specified by law
Conflicts of Interest
We conduct conflict checks before accepting new matters. If a conflict of interest arises during representation, we will inform you promptly and discuss appropriate steps, which may include withdrawal from representation.
Termination of Services
Either party may terminate the attorney-client relationship subject to:
- Written notice as specified in the engagement letter
- Payment of all fees and costs incurred up to the termination date
- Compliance with professional obligations regarding withdrawal
- Transfer of files and cooperation in transition to new counsel if applicable
